Terms of Service

By creating an account on CEMETERRA (cemeterra.com), you agree to these Terms of Service. Please read them carefully.

1. Acceptance

These Terms constitute a legally binding agreement between you and CEMETERRA. If you do not agree, do not use the service.

2. Service Description

CEMETERRA is a cloud-based cemetery management platform. We provide tools for managing cemetery plot records, scheduling grounds maintenance, generating QR memorial pages, and related features as described on our website.

3. Account Responsibilities

• You must provide accurate information when registering.
• You are responsible for maintaining the confidentiality of your password.
• You are responsible for all activity under your account.
• You must notify us immediately of any unauthorized access.

4. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose.
• Upload content that infringes intellectual property rights or is harmful, defamatory, or fraudulent.
• Attempt to gain unauthorized access to other accounts or systems.
• Use automated tools to scrape or abuse the platform.

5. Data and Privacy

Your use of CEMETERRA is also governed by our Privacy Policy, which is incorporated into these Terms.

6. Text Messaging (SMS)

If you are a family contact on a burial record, or a pre-need contract holder, CEMETERRA may text you operational updates about that record — for example, notice that a maintenance task at a gravesite has been completed, or a reminder that a pre-need payment installment is due. These messages are informational, not marketing.

You only receive these messages if you opt in yourself, by ticking the optional, unchecked text-message box when you electronically sign a pre-need contract or interment authorization, or by turning on Text Updates in the family portal. Cemetery staff cannot opt you in on your behalf. After you opt in, we text you once asking you to reply YES to confirm. No further messages are sent unless you reply YES, and none are sent at all if you don't reply or if you reply STOP. Message frequency varies by cemetery and by activity on your record, typically no more than a few messages per month. Message and data rates may apply. Reply STOP at any time to opt out, or HELP for help. Carriers are not liable for delayed or undelivered messages.

Consent to receive text messages is not a condition of using CEMETERRA or of any purchase. Declining or opting out does not affect your, or your family member's, relationship with the cemetery — updates will still reach you through the other channels already on file, such as email or a call from cemetery staff.

7. Data Processing

When we process personal data on your behalf in providing the service, you instruct us to process that data as needed to deliver, secure, and maintain the platform. You are responsible for ensuring you have an appropriate legal basis for data you upload and for providing any required notices to data subjects.

8. Payments and Cancellation

• Paid plans are billed monthly in advance.
• Standard and Pro include 150 text-message segments a month for your cemetery's SMS alerts. Each additional segment is billed at $0.04 USD, automatically, with your next subscription charge.
• You may cancel at any time. Cancellation takes effect at the end of the current billing period.
• We do not offer refunds for partial months.
• We reserve the right to change pricing with 30 days' notice.

9. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance with or without notice. We are not liable for downtime or data loss caused by factors outside our reasonable control.

10. Termination

We may suspend or terminate accounts that violate these Terms. You may delete your account at any time by contacting support@cemeterra.com.

11. Limitation of Liability

To the maximum extent permitted by law, CEMETERRA is not liable for indirect, incidental, special, or consequential damages arising from your use of the service.

12. Governing Law

These Terms are governed by the laws of the jurisdiction where CEMETERRA is established, unless mandatory consumer or data protection laws in your country of residence provide otherwise.

13. EU/EEA Consumer and Data Rights

Nothing in these Terms limits any mandatory rights you may have under applicable EU/EEA consumer protection or data protection laws.

14. Changes to Terms

We may update these Terms from time to time. We will notify you by email or in-app notice. Continued use of the service after changes constitutes acceptance.
